Offer, acceptance

Our offers are always noncommittal and not-binding. All our offers take place under reservation of the delivery opportunity. Unexpected delivery obstacles entitle us to make partial deliveries and/or to withdraw totally or partly from the supply contract. You will be informed in this case. Requirements for compensation cannot be recognized in these cases.

Prices / Terms of payment

The mentioned prices are current market prices. The selling price indicated at the date of placing the order is valid. The prices are quoted in EURO (EUR) including the VAT.

After filling your shopping cart please choose the desired method of payment.

You can choose between the following methods of payment:

  1. Payment in advance by credit card - VISA, EUROCARD/MASTERCARD

    You can send your order with the credit card details either online (SSL encoding) or by fax. For this purpose please print your order form and fax it to +43 1 403 59 91-13.

    On approval of the credit card institute your order will be shipped within three business days depending on the method of dispatch.
     
  2. Payment in advance by bank transfer (after receipt of the invoice)

    After your online-order you will receive the invoice by email or by fax. We ask you to transfer the open amount only after receipt of the invoice.

    No charges for remittances from a bank within the EU (with IBAN and BIC/SWIFT).
    In case of remittances from foreign countries outside the EU we will charge a handling fee of Euro 15,-.

    Shipment of your order will take place within three business days following the receipt of your remittance to the indicated address.

  3. Cash in Euro upon pickup

Delivery

Shipment of your order will take place within three business days after the receipt of your remittance or after approval of the credit card institute to the indicated address.

For orders from countries outside the European Union we ask to consider and observe the applicable customs regulations and customs duties.

If you have any special requests please notify us accordingly. The modified shipping costs - according to your request - will be charged to you and have to be paid on delivery.

Retention of title

We retain legal title to the goods until the customer has discharged all his financial obligations completely.

Rescission / Complaints

According to the Austrian Consumer Protection Act you have the right to rescind the contract / return the goods within seven business days (Monday to Friday) from the date of receipt of delivery. Timely dispatch within the deadline is sufficient.

The goods have to be unused and in condition to resale, otherwise we have to charge the customer a fee for having used the goods. Furthermore, the customer is not entitled to rescind the contract if the seal and the cellophane packing of CDs have been opened. The return of the goods shall take place in orderly and stable packing and at your expense. Unpaid postage for returned goods can not be accepted. Unpaid postage for returned goods

Payments which have already been made will be remitted to the indicated account on receipt of the returned goods.

Place of jurisdiction

Bühnen- und Musikalienverlag Josef Weinberger Wien, Gesellschaft m.b.H. is a company registered in the commercial register (no. FN 129246 v, commercial court Vienna) and situated in Vienna. The place of jurisdiction is Vienna and Austrian law shall govern. For consumers the relevant regulations of the Consumer Protection Act shall apply.

Severability

If individual terms of these General Terms and Conditions are or will become ineffective and/or void as a whole or in part, this fact shall have no effect on the validity of the remainder of the terms and the contracts signed. The parties to the contract agree to replace the ineffective/void term by one which serves the purpose of the contract as closely as possible.
